1. Agreement
By creating a PerkClub account, you (the "Merchant") agree to these Terms of Service with PerkClub ("we", "us"). If you don’t agree, do not use the service.
2. Service
PerkClub provides a software platform that lets independent businesses run paid membership programmes — sign-up flow, billing, wallet passes, kiosk redemption, and merchant analytics. See features for the current capability list. The service is offered as-is and may be updated, expanded, or have individual features changed at any time.
3. Plans and billing
PerkClub plans are described on the pricing page and are billed monthly in advance via Stripe. All plans are rolling 30-day contracts and may be cancelled at any time from the merchant dashboard. A 1.5% + 20p per-transaction fee applies to membership payments collected through the platform; this covers payment processing.
4. Merchant responsibilities
- Provide accurate business information when signing up and keep it up to date.
- Honour the perks promised to your members in good faith.
- Comply with all applicable UK consumer protection, advertising, and data-protection law.
- Maintain a working Stripe account so member payments and your weekly payouts can process correctly.
5. Member relationship
The contractual relationship for membership perks is between the Merchant and their member. PerkClub provides the technical platform; the Merchant is responsible for fulfilling the perks they sell. PerkClub may, at its discretion, refund a member if the platform malfunctions in a way that materially prevents redemption.
6. Acceptable use
You may not use PerkClub to sell anything illegal under UK law, to violate Stripe’s prohibited business categories, or in any way intended to defraud customers. Doing so is grounds for immediate termination.
7. Termination
You can cancel at any time from the merchant dashboard. We can terminate or suspend an account with notice (or immediately, in the case of fraud or breach of these terms). Upon termination, active memberships continue until their current billing period ends; we will pay out remaining balances minus any outstanding fees.
8. Liability
To the maximum extent permitted by UK law, PerkClub’s liability for any claim arising from the service is limited to the fees paid to PerkClub in the twelve months prior to the claim. We are not liable for indirect, incidental, or consequential loss.
9. Changes
We may change these terms with 30 days’ notice via email or the merchant dashboard. Continued use after the effective date constitutes acceptance.
10. Governing law
These terms are governed by the laws of England and Wales, with exclusive jurisdiction in the English courts.
